As noted in our last update, the Board has made corrections/updates to the proposed CCnRs to address typos and a lack of clear language with regard to Vehicle requirements, as well as drafted an initial set of HOA Rules. Please find the details below.
We have received great comments from some members of the community. Please continue to share your thoughts with the Board directly and with the entire community at our annual meeting on November 19th. These documents are for the benefit of us all and we welcome and need the feedback.
The main goals of the governing documents was to 1) address legal non-compliance, 2) propose a voting/governance process structure that allows for the community to be flexible and adjust permissions and restrictions as needed moving forward, and 3) address moot provisions, inconsistencies and lack of readability of the documents. The proposed changes were not meant to overhaul existing restrictions and permissions and the Board purposefully did adjust the majority of them.
Many of the comments we have received from the community relate to specific existing permissions or restrictions modification requests and or comments that some provisions need examples or greater clarity. We are keeping track of all issues raised. However, our current governing documents and voting process do not provide a flexible means with which to address these new requests for consideration. That is why the proposed governing documents incorporated concepts like the HOA Rules which provide a process for adjusting to needed change whether based on legal requirements or community feedback. The new governance process, if approved, will provide a much more flexible means to address considerations the community has raised with specific permission and restrictions.
CCnR Corrections/Updates
Typos and unclear language in Section 10.2 of the proposed CCnRs regarding Vehicles have been addressed. The changes are meant to ease some of the existing restrictions contained in Section Article X, Section 1 of our current CCnRs.
A change was made to clarify the ACC’s role in the HOA rules process.

HOA Rules
Based on community feedback, enclosed is a proposed set of HOA Rules. The HOA Rules are based on our existing governing documents and address items like architectural review and guidelines and yard maintenance. The HOA Rules contain the only newrequirements for the community, but also eliminate some existing ones.
- Required fees for every ACC review request has been eliminated.
- New requirements related to temporary constructions areas have been included (e.g. screening porta-potties)
- Fines – The right of the Board to impose fines is a best practice remedy for non-compliance and less impactful than the rights the Board has today like imposing property liens.
- Permission to reserve the Community Park is addressed.
- Limitations on offering items for free or sale from a Lot is addressed.
