Based on initial community feedback, the Board is making corrections to the proposed CCnRs to address inadvertent misstatements in the document, as well as provide a draft of the Rules for the community.
Typos in Section 10.2 of the proposed CCnRs regarding Vehicles will be addressed and updated. Please note that the vehicle restrictions are existing restrictions contained in Section Article X, Section 1 of our current CCnRs. The proposed changes (once corrected) are an attempt to adjust those restrictions to account for actual, reasonable practice of homeowners today.
The Bylaws and CCnRs permit the HOA to create Rules for the Association. Rules are a best practice method and process for homeowner’s associations like ours to address more detailed permissions and restrictions of a community that may change over time or may need to adapt to meet regulatory/legal requirements. Given the volunteer nature of the Board, and how long it had already taken to generate the proposed Bylaws and CCnRs, the Board originally thought that it would be beneficial to wait to draft Rules to allow for additional thought and time, so the focus was placed on the proposed Bylaws and CCnRs. We understand that there is already a lot to assess, so the original thought was to not complicate it more.
However, we have received feedback from the community that it is actually more difficult to make a decision when it feels like some items are not addressed or there is a lack of information. You are right. Rules based on our existing governing documents (just like the majority of the Bylaws and CCnRs) are being finalized.
As soon as possible, we will circulate updated proposed CCnRs (along with a red-line showing the changes), as well as a set of proposed Rules. Please be on the lookout for those!
If you have already submitted your ballot, we will be reaching out to you to provide a new ballot, so that you can vote based on accurate information.
