Final non-substantive changes to the proposed Governing Documents:
Thank you all for your participation, comments and questions! After our final Q&A call with the community regarding the proposed Governing Documents, the Board worked with our attorney to address final clean up and minor non-substantive clarification and structural issues with the proposed documents.
First, to be consistent with how specific building/construction material requirements are handled, existing requirements related to driveway materials and fencing materials (Section 11.1 and 11.5) were moved from the proposed CCnRs to the Rules (joining roofing, siding, etc. requirements).
We had several questions regarding Plat Map descriptions. There are two applicable plat maps to the community. Unfortunately, they both use the same Tract references, so there are, for example, more than one Tract A or B. Our attorney updated the proposed Bylaws and CCnRs to accurately reflect which plat map is referenced. There are no changes – simply updates to point to the correct plat map.
Finally, while not resulting in any proposed changes, we had several questions regarding existing provisions and their application to existing homes. Because of that, we wanted to clarify that any home or project that exists that was originally built or approved by the HOA/ACC is grandfathered into compliance. The HOA cannot and will not retroactively enforce any provision for homes, construction or projects that were previously approved.
